These Terms of Service set out the rules for using this website, mtstreams.com. By using the website you accept them. If you do not agree, please do not use it. The rules for the interest list itself are set out separately in our Terms and Conditions.
1. Who runs this website
This website is operated by Rostyslav Dmytruk, 22 Luhova Street, Kyiv 02000, Ukraine (“we”, “us”). You can reach us at [email protected] for legal questions, or at [email protected] for anything else. Further details are on the Legal Information page.
2. What this website is
This is an information website about Mountain Streams Resort & Casino, a resort planned on the Hardangerfjord in western Norway. The resort has not been built and is not open. The website does not take bookings, reservations, deposits or payments of any kind, and nothing on it is an offer to sell accommodation, food, spa treatments, events or any other service.
All images are artist’s impressions. Descriptions of rooms, restaurants, the spa, the events spaces and Kvasir’s Hall describe what is planned, not what exists. Layouts, areas, capacities, finishes, names and facilities may change during design and construction, or may not go ahead at all. The entertainment and gaming lounge is subject to licensing and will open only if Norwegian law allows it and the necessary permit is granted.
3. Age
This website is intended for adults. You should be at least 18 years old to use it, because it describes a planned gaming lounge that will be open only to adults. The quiz and riddle content on the website is for fun and involves no money or prizes.
4. Intellectual property
Unless stated otherwise, everything on this website belongs to us or is used with permission. This includes the text, the artist’s impressions and other images, the Mountain Streams name and logo, the design and layout, the code, and the riddles and quiz questions written for the website — including the riddle of the day and the questions on the flip cards. They are protected by copyright and other intellectual property laws.
You may view the website, print or save pages for your own personal, non-commercial use, and share links to it. You may also quote a short extract, or a single riddle, with a clear credit and a link back to this website. You may not otherwise copy, republish, sell, adapt or distribute the content — for example, you may not reuse our riddles in a commercial quiz or publication, or use our images in advertising — without our written permission. Names of other businesses mentioned on the website, including other resorts referred to for comparison, belong to their respective owners. Their mention does not imply any connection with, or endorsement by, those owners.
5. Acceptable use
When using the website you agree not to:
- use it in any way that breaks the law or infringes anyone’s rights;
- try to gain unauthorised access to the website, its server or any connected system, or interfere with its security;
- overload the website, including by automated scraping, crawling or bulk requests beyond what ordinary search engines do;
- introduce viruses, malicious code or anything else that could harm the website or its visitors;
- send us, through the interest list or by email, false information, other people’s personal data without their permission, or content that is unlawful, abusive or spam;
- present the website, its content or our name in a way that suggests we endorse you or your business, or that the resort is open or taking bookings.
We may block access from any address that breaks these rules.
6. Accuracy of information
We take care to keep the website accurate, but because it describes a project in development, some information will change, and some may be out of date at any given moment. Information about Hardanger, the fjord, the glacier, the orchards and Norwegian law is given for general interest only and is not professional advice. Please check anything important — for example travel arrangements or legal requirements — with an official source.
7. Links to other websites
The website links to a few other websites, such as Hjelpelinjen and public authorities. We include them because they may be useful, but we do not control them and are not responsible for their content, availability or privacy practices.
8. Availability
The website is provided free of charge and “as is”. We do not promise that it will always be available, uninterrupted or free from errors, and we may change, suspend or withdraw any part of it at any time, without notice.
9. Limitation of liability
To the extent permitted by law, we are not liable for any loss or damage arising from your use of the website or your reliance on its content, including any decision you make — such as travel plans or financial commitments — on the basis that the resort, or any particular facility, will open on a certain date or in a certain form. We are not liable for indirect or consequential loss, or for loss of profit, business or opportunity.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded by law. Nothing in these terms affects the rights you have as a consumer under the mandatory law of the country where you live.
10. Privacy and cookies
How we handle personal data is explained in our Privacy Policy. The website sets no cookies; its one small browser storage entry is explained in our Cookie Policy.
11. Changes to these terms
We may update these terms from time to time — for example if the website starts to offer bookings. The date at the top shows the latest version. The version in force when you use the website applies to that use.
12. Governing law
These terms are governed by the law of Ukraine. If you are a consumer, you also keep the protection of the mandatory rules of the country where you normally live, and you may bring proceedings in the courts of that country. More detail on disputes is given in our Terms and Conditions.
